1. Acceptance of Terms

By accessing or using the ModernBroke Service (the website modernbroke.com, related social media content under the @themodernbroke brand on YouTube, Instagram, and other platforms, and any associated features — collectively, the "ModernBroke Service" or "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the ModernBroke Service.

ModernBroke ("ModernBroke", "we", "us", or "our") reserves the right to update these Terms at any time. See Section 11.

2. Description of the ModernBroke Service

The ModernBroke Service provides:

  • An archetype quiz at modernbroke.com/quiz that assigns users one of seven financial archetypes (Brad, Emily, Tyler, Sarah, Rachel, Daniel, or Marcus) based on their responses to seven questions
  • Editorial and entertainment content about modern American financial realities, distributed across the modernbroke.com website and @themodernbroke social media accounts
  • Optional email updates for users who choose to opt in

The ModernBroke Service is provided for entertainment, cultural commentary, and educational purposes only.

3. User Eligibility

To use the ModernBroke Service, you must be at least 13 years of age. By using the ModernBroke Service, you represent and warrant that you meet this age requirement.

Users between 13 and 17 should have parental or guardian permission to use the ModernBroke Service.

The ModernBroke Service is not intended for children under 13.

4. User Conduct

You agree NOT to:

  • Use the ModernBroke Service for any unlawful purpose
  • Submit false, misleading, or harmful information through the quiz, contact form, or any other input
  • Attempt to access ModernBroke systems, accounts, or data without authorization
  • Scrape, crawl, or harvest content from the ModernBroke Service in violation of robots.txt or by automated means without prior written consent
  • Reverse-engineer, decompile, or attempt to extract the source code or quiz scoring matrix of the ModernBroke Service
  • Impersonate ModernBroke or any other person or entity
  • Interfere with or disrupt the ModernBroke Service, including by introducing malware, viruses, or excessive automated requests
  • Use the ModernBroke Service to harass, defame, or harm any person
  • Violate any applicable laws or regulations through your use of the ModernBroke Service

5. Intellectual Property

5.1 ModernBroke Content

All content on the ModernBroke Service — including but not limited to text, graphics, video, audio, the seven archetype framework (Brad, Emily, Tyler, Sarah, Rachel, Daniel, Marcus), the quiz questions and scoring matrix, brand identity, and editorial copy — is the property of ModernBroke and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any ModernBroke content without prior written consent, except:

  • You may share links to publicly available ModernBroke pages and social media posts
  • You may share your individual archetype result for personal, non-commercial purposes
  • You may engage with @themodernbroke social media content per the respective platform's terms (like, share, comment as the platform permits)

5.2 User Submissions

By submitting quiz answers, email, or contact form messages to ModernBroke, you grant ModernBroke a worldwide, non-exclusive, royalty-free license to use that submission to provide and improve the ModernBroke Service.

You retain all rights to your submitted information. ModernBroke does not claim ownership of your personal data.

6. Third-Party Services and Links

The ModernBroke Service may link to or integrate with third-party services (YouTube, Instagram, TikTok, and others). ModernBroke is not responsible for the content, policies, or practices of those third parties. Your use of third-party services is governed by their own terms and policies.

7. Disclaimers — ModernBroke Is NOT Financial Advice

ModernBroke is an entertainment, cultural commentary, and editorial brand. The ModernBroke Service does NOT provide financial, investment, tax, legal, accounting, or any other professional advice.

The seven archetypes (Brad, Emily, Tyler, Sarah, Rachel, Daniel, Marcus) and all associated content are creative characterizations of common financial situations in modern America for editorial and entertainment purposes. They are NOT:

  • Personalized financial recommendations
  • Investment guidance
  • Tax planning advice
  • Debt management strategies
  • Endorsements or recommendations of specific financial products or services
  • Substitutes for advice from licensed professionals

Before making any financial, legal, or tax decision, you should consult a qualified, licensed professional who can evaluate your specific situation.

ModernBroke makes no warranties, express or implied, about the accuracy, completeness, suitability, or reliability of any information on the ModernBroke Service. The ModernBroke Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.

To the maximum extent permitted by law, ModernBroke disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ModernBroke and its officers, employees, agents, partners, and licensors shall NOT be liable for:

  • Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of or inability to use the ModernBroke Service
  • Any financial decisions you make based on or influenced by ModernBroke content
  • Any unauthorized access to or alteration of your transmissions or data
  • Any statements, conduct, or content of any third party on the ModernBroke Service or linked services
  • Any matter relating to the ModernBroke Service

In no event shall ModernBroke's total liability to you for all damages exceed the greater of (a) the amount you paid ModernBroke in the 12 months prior to the claim (if any), or (b) one hundred US dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

9. Indemnification

You agree to indemnify, defend, and hold harmless ModernBroke and its officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the ModernBroke Service
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights
  • Any financial, legal, or other decision you make based on the ModernBroke Service

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms or the ModernBroke Service shall be resolved exclusively in the courts located in the Russian Federation, unless mandatory consumer protection laws of your jurisdiction apply.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11. Changes to These Terms

ModernBroke may modify these Terms at any time. Material changes will be communicated by:

  • An updated "Last Updated" date at the top of these Terms
  • A notice on the modernbroke.com homepage
  • Email to subscribers (if you have opted in)

Continued use of the ModernBroke Service after changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, discontinue use of the ModernBroke Service.

12. Termination

ModernBroke reserves the right to terminate or suspend your access to the ModernBroke Service at any time, with or without cause or notice, for any reason, including violation of these Terms.

Upon termination, your right to use the ModernBroke Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.
